By purchasing goods from mailordertrees.co.uk you enter a legally binding agreement with us on the following terms. Please read and understand these terms because they affect your rights and liabilities.

The terms below reflect the basis for purchase by you and sale by us of the items described on this site.

Definitions:

The Contract – The agreement between ourselves for the sale and purchase of goods.

The Goods – The range of plants which are available for purchase from the website.

The Website – The website of mailordertrees.co.uk present on the world wide web.

The Seller, we or us – mailordertrees.co.uk

Basis of the Sale

Our aim is to give you a clear description of the plants we sell but inevitably there may be slight variations in shape, size or colour between the goods advertised and those despatched. Our photographic illustrations are for your guidance only. We do not make substitutions of a material nature without contacting you first.

Orders are accepted on the basis of stock being available, your address being in our delivery area and your credit or debit card being authorised for the transaction. If we cannot obtain full payment prior to despatch, we may cancel the contract and suspend delivery.

There is no minimum order.

In the unlikely event of a price increase between us receiving your order and despatching it we will e-mail you for instructions. Prices quoted are inclusive of VAT where relevant

Delivery

We will deliver the goods to the address you specify for delivery in your order. It is important that this address is accurate. Please be precise about where you would like the plants left if you are out when the courier delivers. We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions.

We aim to deliver within the time specified on our delivery page but cannot be held responsible for factors beyond our control. We will also try to avoid lifting bare-rooted trees during very frosty periods as we want them to reach you in the best condition.

Returns

We will ensure that plants are in top condition when they leave mailordertrees and we will package them so that they reach you in the best condition.

In the unlikely event that you take delivery of a plant that is in bad condition when you take it out of the box, contact us immediately. We may then ask you to send us a photograph so that there is no doubt as to it's condition on arrival with you. A deciduous tree or shrub that is delivered in the autumn/winter will have lost it’s leaves and won’t look like the colourful photograph you will have seen on the website! So, please be aware of the seasonal variances. However, provided that you have contacted us within 7 days of receiving a damaged plant we will be happy to arrange for a refund or replacement.

Ownership

The Customer will assume ownership of the goods once they have been successfully delivered and we have received clear payment in full. We supply goods on the assumption they are not for resale. We cannot accept liability for loss or damage for goods once they have been delivered in accordance with your instructions.

If you have a problem with a plant within the first 12 months of purchase please contact us for guidance, preferably with a photograph. We supply a planting guide with orders and cannot accept responsibility for losses due to lack of aftercare including under/overwatering and adverse weather conditions.

Cancellations

If you change your mind and decide to return an order to us we will accept it on the basis we receive it back in it’s original condition and packaging, at which point we will issue a refund. We suggest you send it by recorded delivery because, until we receive the goods, they are your responsibility. We will not pay postage for cancelled orders and reserve the right to withhold a percentage of the refund if we are obliged to reduce the price of the item for resale.

Security and Privacy

We will not pass your details on to any third party.

Your payment details will be handled using secure server software which will encrypt all your personal information and keep them safe.
